Praetorian Protest event spawning waves at level 1

In the Praetorian Protest event, I experienced the initial protestors spawning levelless (ie scaling, as expected), but subsequent waves of Destroyers and the Protest Leaders all spawned at level 1.

 

This was on a fresh level 8 Mastermind with henchmen.  I participated with prestige power attacks, and received the badge.
