    Agreed.

    It didn't hurt that the game maker had already been making a good faith effort to minimize infringements.

    December 12, 2005 - Marvel Entertainment, Inc., NCsoft® Corporation, NC Interactive, Inc. and Cryptic Studios, Inc. are pleased to announce today that they have amicably settled all claims brought by Marvel and all claims brought by NCsoft, NC Interactive, Inc. and Cryptic Studios, Inc.

    From the statement: “The parties' settlement allows them all to continue to develop and sell exciting and innovative products, but does not reduce the players' ability to express their creativity in making and playing original and exciting characters. Therefore, no changes to City of Heroes® or City of Villains' character creation engine are part of the settlement. The parties have agreed that protecting intellectual property rights is critically important and each will continue aggressively to protect such rights in accordance with all applicable laws. While the terms of the settlement were not disclosed, all parties agree that this case was never about monetary issues and that the fans of their respective products and characters are the winners in this settlement.”

     

    Some keys to arguments before the settlement included:

    #1 The game makers argued in a response to the initial complaint, that characters named after third party properties were not allowed to be played in the game, and that, given the character creation engine of the game, similarities to Marvel characters may exist, but constitute a fraction of the possible outcomes of player-designed characters.

    #2 The lawyers bungled it. Screenshots used as exhibits in the original complaint which claimed were players found in the game were actually characters created by the attorneys for Marvel in an attempt to prove their point that characters with names that infringed copyrights could be created in City of Heroes. Marvel’s counsel later admitted this to be the case with three of the characters shown in the exhibits it submitted.

    I'll agree with your premise. I too hope reasonable judgement prevails.

     

    While Napster came and went, royalties still get paid to entities that control the intellectual property. If those royalties aren't paid it gets ugly quick.

    I'll point to recent music news where an artist I'm embarrassed to name will be re-recording all of their music because someone else has control of the recordings already made.

     

    ISPs and services regularly have to pull user generated content that violates copyright or trademarks. It's the deep pockets that are held accountable. Those deep pockets aren't interested in discussion as much as minimizing exposure to risk and liability. - Live long and... have fun.

    ..this version as well as others could absolutely be 'shut down'. Cease and desist letters are not limited illegal behaviors. When ignored, letters lead to orders. Orders are temporary injunctions which freeze the offending action until a trial. Before any trial, the terms 'contributory infringement' and 'liable' get tossed around enough to pucker the sphincters of anyone even loosely associated with the offense that is not seriously lawyer-ed up.

     

    Sinking dozens or hundreds of hours into a tenuous situation and then being flippant about the mention of a legitimate concern could be considered foolish.

     

    Personally, I'm not stressed about it. This is all temporary.

    'objectionable activities' was supposed to refer to the use of inappropriate words or crude language in character names. this mechanic is likely already in place and could be easily expanded.

    Anyone who thinks they are too big to 'care' is mistaken. Use of copyright or trade marked materials is what it is.

     

    Powers - Costumes - Names - Catch phrases. Copying all of that could be problematic. Enabling behavior could be liable.

     

    Blocking names could be the simple/easy solution and also then documents a good faith effort AND to curb objectionable activities (like inappropriate words in names).

    I believe that the examples I've seen for comic cons typically avoid using the names of the specific characters. This is sufficient.

    Using in game options to mimic costumes is part of fandom. A large green character with purple pants who is strong.. no problem. Naming that character Angry Guy or Smash.. no problem.

    This is debatable by design.

    Play style can be a factor. Time can be a factor (spike vs sustained). Survivability can be a factor. Target type can be a factor.

     

    It can be about more than just mashing buttons.

I know I rarely if ever play mine anymore, and every time I do I think of how I could be playing one of the many fun characters I have instead and performing better to boot.

     

    Cool animations, iconic powerset. Terrible +dam mechanic.

    Of course immediately it appears there might be a correlation between posted builds on the net (going back to live), hype (fotm now and then) and lack of creativity (min/max copycats).

     

    Maybe that's harsh.. but it's really hard to roll a truly terrible combo.

    So really the question is, are those benefits the corruptor has worth more in the long run or less?  I'm usually concerned with endgame quality as a goal since leveling up is so fast that it is only a small fraction of the time spent with a character. I don't intend to solo a lot, if that also makes a difference, I'm generally more team-oriented.

     

    Any thoughts?  Should I reroll before I get in too deep?

    Curruptors are definitely not Defenders.

     

    That said, damage can be the more difficult thing to find later in the game.

In the meantime, it won't hurt to just add Wind Control with minimal effort since it's already pretty much done.     The current non-profit game has a lot of potentially unused in game billboards that NCSoft could 'leverage'.

     

    Love / Hate? I get it. However, I like playing on a public version more than I'd hate that idea.

    From zero to level 35/40 (suggestions, not definitive)

    • Death from Below (DFB) 3-4 times (to get the +acc,+dmg,+rec, and/or +def hydra enhancers (good to level 22))
    • Drowning in Blood (DiB) 2-3 times (to get the +tohit,+dmg,+rec, and/or +def shivan enhancers (good to level 30))
    • Positron 1

    Important - If you hate the character or powers at this point, re-roll. Don't waste time on one you don't love.

    • Positron 2
    • Exploration badges when not doing the above
    • AE badge mission
    • Safegaurd missions (badges)
    • Misc TFs as teams form (Synapse Task Force, Katie Hannon, etc)
    • Finish up some accolades

    That typically can get to 35-40 with more than enough to buy IO enhancements. (I just do SOs until IOs provide high values)

    Note: this skips a lot of content and story arcs which can result in losing out on 300+ reward merits. If you've got lots of funds on other characters it's not a super big deal. if someone is new, that's a hit.

    After 35/40 there is tons of content.

    Level 50 used to take players somewhere between 100 and 250 hours of play. It has greatly decreased. Definitely use xp boosts from the P2W vendor.

     

    200+/- hours sounds like a long haul but there is so much content and interesting players along the way. There were really only a handful of levels that would feel like a grind. It was a little different then - we didn't have travel powers until level 14, had to unlock capes, auras & costume slots, earn re-specifications (to revamp your entire build from scratch) and walk uphill both ways in chest high snow..

  15. See subject. Also, what does IO stand for? My highest character is level 24 and I don't really know what I'm doing.

     

    Don't stress about Invention Origin enhancements yet. I'd suggest sticking with Dual Origin and when possible Single Origin until you get a bit higher up. IOs are great in that they don't stop working as you level but they also don't increase in effectiveness.

     

    SOs can be bought but also earned. Doing the Death From Below (DFB) or Drowning in Blood (DiB) trials which can yield 4-5 SOs per run for low level characters. (you can also a bonus at the end, up to 4 unique, one per run)

    Single-Origin Enhancements, often referred to as SOs, are even more powerful. They provide twice as much improvement as DOs (or four times as much as Training) and may be used only by a character whose origin matches the Enhancement's.

     

    Single-Origin enhancements may be bought at origin-specific stores and NPCs in various zones and, at an inflated cost, from individual contacts. Currently, the lowest level Single-Origin Enhancements generally available for purchase are level 25, which are usable by characters of minimum level 22. There are, however, some particular exceptions as low as level 13 sold in Mr. Yin's store, allowing some characters to use some SOs as early as level 10. SOs are dropped by enemies for characters of level 22-50. SOs are also sometimes provided as mission bonuses, and in the cases of Task Forces and Story Arcs, the player may even choose the aspect.

     

    SOs in certain level ranges for Heroes may only be purchased from contacts that require a mission before they will deal with you. Here is a quick reference. More detail in each contact's page and on the Stores Inventory page.
