  1. @Cipher, @Jimmy Do you guys have any comment on this? Is Titan going to stay independent going forward? Is Titan, and just not Tony V still a part of these negotiations? Seems like big news...and silence is always worrisome in those situations.

  7. It came up in August and July as well...It's recurring, like the Full Moon. The moon won't do anything different this month than last month, but the Full Moons keep on coming.
  8. The question about trademarks usually comes down to "Would it confuse the customer?". If 2 companies operate in completely different markets, then yes they can share the same name. Although for made-up words that tends to be harder. Delta Airlines and Delta Faucets are pretty easy to separate. But if I made a comic book called "Coca Cola Man", and tried to trademark it, I'd probably lose because any customer is going to think that Coca Cola made that product. Trademark is limited to words, slogans, symbols and logos. Symbols/Logos are as close as you get to an image. However Congress keeps extending copyright protections (originally 28 years), now 95 years. So for most modern works, trademark and copyright really are intertwined. However, in 1923, should Congress not take further action (and it seems unlikely there will be enough backing to extend it any further), then you can make and sell as many Steamboat Willie knock offs that you like. But still all modern versions of the mouse will still be protected, so it won't open the gates to any Mickey Mouse knock-offs.

"I want to be a good citizen"->"Copying other peoples works might be against the law"->"I hate people who copy other people's works" OR "I want people to be more creative"->"Copying other peoples works might be against the law"->"You shouldn't copy other peoples works, it's illegal" I'm not standing up for either POV...but it's normative...We all (all of us) live in our own echo chambers and lean on the facts that support what we believe...

This is pretty close...The italicized part is slightly off...these sites may absolutely be infringing upon other copyright holders, but their ability to do so, has not been challenged thus fair. The distinction is made really clear in the 2nd paragraph...Could DC/Marvel target DeviantArt? Yes...Would they win? Probably...Would it be worth it? Probably not, court costs and the public backlash would be pretty high... Fan Art by itself has not been established as a fair use exception to copyright yet...Homage can be covered, if the fan art is transformative, And transformative works are why there is such a plethora of superheroes across multiple publishers today. It's why you have Justice League and the Squadron Supreme, Mr. Fantastic and Elongated Man, Namor/Aquaman, Bullseye/Deadshot, Deathstroke/Deadpool, etc, etc. I'm pretty sure that the daily Dr. Strange or Superman sighting is not "Homage", since they are almost identical. Parody is also covered, however Parodies must be exactly that...they must be somehow ridiculing something, so 90% of superhero clones in CoH would fail to meet that test. Regardless, the industry seems pretty lax about it - just walk into any comic convention... There is absolutely fair use for Trademarks...Product Review sites don't have to get permission from the product owner in order to review them. I can say, well within my 1st amendment rights, that I think Superman is far superior than Batman. Both are trademarked, and both are protected under the nominative fair use exception for trademarks. Creating a Batman look alike is a copyright violation, not a trademark. Creating a character whose secret identity is Bruce Wayne is likely a copyright violation, but is definitely not a trademark. Creating a lizard blaster and calling him Batman, is absolutely a trademark violation. And creating any superhero with the word "superhero" in it is a violation of trademark (oddly Marvel/DC jointly own a trademark on Superhero) Is using these names (or slight variations like Bat-Man or Bat-manX, or Batman 2) a violation of trademark law? Most definitely...but it's something that IF Homecoming gets contacted about, they can do what's already been stated, just remove those names from the existing characters (like live) and motor on. TL;DR - The legality of these issues is always a big questions mark. However, the enforcement of them, in this situation (fan art) is extremely lax, and given the non-commercial nature of what HC is doing here, I'm highly dubious that there will be any action against the look or origin of characters. Ultimately, maybe naming rules come into play, but even that's not a certainty...

  16. This is personally my #1 pet peeve right now...I just want to click the big "PLAY" button, and then I have to remember to click the 64 bit app first... It's a wonderful, wonderful world, when ones' biggest pet peeve is having one extra mouse click...

  19. While I would agree I would rather have a new Wiki now instead of several months from now...I would much rather we not waste our time doing it, even if it means we have to do without... I wouldn't be a likely contributor (and you know I am shy about writing), if I know it all becomes throwaway, one way or the other in a few months... It might take 2 years...I understand...I don't think it will...but regardless, we have robust forums and in-game help...
  20. Here's the deal, hope this helps... ParagonWIki is part of the Titan Network, owned by @TonyV. It is the wish of the Titan Network that Paragon Wiki be a final snapshot of how the game was when it sunset...I assume as a general policy of that, they don't allow editing of pages any more. Homecoming and the Titan Network are jointly working with NCSoft to make the game street legal and not a bootleg anymore.... If they are successful, then Titan Network will allow us (and they would be part of the us) to update Paragon Wiki with all things Homecoming If they are not successful, then NCSoft will no doubt issue a C&D letter and all the big servers (Coxg, Rebirth, and especially Homecoming) will be shut down So the reason to wait this out is a.) they succeed, and it'll be 1,000,000X easier to update Paragon Wiki, then to clone it and try and update it... b.)they fail, and there is literally no more Homecoming to play, and any updates are unneeded.... So that's where the advice to wait it out is coming from...I'm not trying to throw shade, and dump rain on your parade...I'm quite hopeful things will succeed (because what can I gain by being grumpy about it)...So just hang in there a while (few months longer)...

  24. At this point, it seems like wait and see would be a better approach, because if the deal goes thru, we can just update Paragon Wiki with all things HC...and if the deal doesn't go thru, well then, none of this will matter anymore
