You do have a point, if memory serves, Superadine is also green in color, most likely an invention in combination with Bane's Venom and Hulks Gamma Radiation.

That is something that cannot be copyrighted. We (everyone on the forums) keep saying copyright, but what this is truly all about is not copyright, but rather Intellectual Property. But no, green is not something that anyone can claim as their intellectual property, otherwise Image Comics and The Savage Dragon would have a lot of explaining to do, heh.

1.) Disney sued a school for showing The Lion King at a charity fundraiser. They are notoriously sue-happy.
2.) It's part of the terms and conditions you agree to when you play the game.

If you don't enforce copyright, you lose it.  Once a precedent has been established that a company won't enforce it for whatever the reason, it becomes ammunition for others to violate it going forward.

Yes, it can be a headache. Take an aspirin, and consider that 'aspirin' used to be a trademark of Bayer, and still is in some 80 countries. Other genericized trademarks include dry ice, escalator, laundromat, kerosene, lanolin, hovercraft, linoleum, teleprompter, trampoline, videotape, zipper, windbreaker, tabloid, granola, thermos, and yo-yo.

Ok, besides other generalized copywriter issues & examples as others have said here, let's just focus on CoH Homecoming (and even other servers such as Thunderspy for example)...

   Such fan-run servers as you said do NOT own the IP address of the game at all; only NCsoft does, and no company... I repeat, no company who owns such property rights will tolerate any copy written infringement even in "name" only. Such was the case with Disney as @Captain Fabulous mentioned. And because of this, NCsoft (who still owns the rights to CoH's) will allow any such copyright violations in something they still own.

   Just because they have not shut down Homecoming, Thunderspy, and every other server who has created fan-run blessings for us, doesn't mean they won't in a heartbeat if they suspect we (Homecoming for example) is letting violations happen. So the Dev's, understandably so, enforce this so as to keep the lights on, and we players as a general whole support this. Because let's face it, every day all of us are able to play this game we all love so much, is a huge blessing... and that is why we will do (most) anything to preserve and protect it, including agreeing to the terms of service we all click on when signing into the game.

   That is the simple fact of it all...

That's trademark. Copyright is yours regardless of whether or not you enforce it.
